Terms and Conditions
By using Underwaterly, you agree to abide by the following terms and conditions:
Use of the app is at your own risk.
You must be of legal age or have parental consent to use the app.
You are responsible for maintaining the confidentiality of your account.
You may not use the app for any illegal or unauthorized purpose.
Our liability is governed by the "Liability" section below.
We reserve the right to modify or terminate the app at any time.
Subscription and Payment
The Underwaterly Premium subscription is offered on a monthly or yearly basis at the price shown at checkout, plus any applicable taxes. Your subscription renews automatically at the end of each billing period unless you cancel it before the renewal date.
You can cancel at any time via 'Account' → 'Payment' → 'Manage Subscription' in the app. Your subscription remains active until the end of the current billing period; no partial refunds are given for the remainder of a paid period, except as set out under "Right of Withdrawal" below.
We may change subscription prices for future billing periods. We will notify you of any price change in advance and, where required by law, obtain your consent before it takes effect.
Right of Withdrawal
If you are a consumer within the European Union, you have the right to withdraw from your Underwaterly Premium subscription within 14 days without giving any reason.
Right to withdraw. The withdrawal period is 14 days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us — Underwaterly, Boltzmannstraße 3, 85748 Garching, Germany, Email: legal@underwaterly.com, Phone: +49 170 6002847 — of your decision by a clear statement (e.g. a letter or an email). You may use the model withdrawal form below, but this is not obligatory. It is sufficient to send your withdrawal notice before the 14-day period has expired.
Effects of withdrawal. If you withdraw from this contract, we will reimburse all payments received from you without undue delay, and in any event no later than 14 days from the day we are informed of your decision to withdraw. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise, and you will not be charged any fees for this reimbursement. If you asked us to begin the service during the withdrawal period, you must pay us an amount proportional to what was provided up to the point you told us you were withdrawing, compared with the full scope of the contract.
Early expiry of the right of withdrawal. By actively choosing immediate access to your Underwaterly Premium subscription during checkout, you expressly agree that we start performing the contract before the 14-day withdrawal period has ended, and you confirm you understand that you lose your right of withdrawal once the contract has been fully performed. If the contract has not yet been fully performed, your right of withdrawal continues to apply on the pro-rata basis described above.

Intellectual Property
All content and materials available on Underwaterly, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, are the property of Underwaterly and are protected by applicable intellectual property laws. Unauthorized use or distribution of any materials from the app is strictly prohibited.
Liability
Underwaterly provides the app on an "as is" basis and makes no representations or warranties, express or implied, regarding the app's operation or the accuracy, completeness, or reliability of any information provided, except as set out below.
We are liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty by us, our legal representatives, or our vicarious agents, for damages covered by the German Product Liability Act (Produkthaftungsgesetz), and for damages caused by intent or gross negligence.
For damages caused by ordinary negligence, we are liable only if that negligence relates to the breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place, and on whose observance you may regularly rely). In such cases, our liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded. This limitation also applies to the personal liability of our employees, representatives, and vicarious agents.
Governing Law
These terms and conditions are governed by German law. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence. Any disputes shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory consumer-protection law provides otherwise.
